Coaching Foundations: Full Terms and Conditions (inc refund policy)

These T&Cs form the entire contract between Peak Positive (the Provider) and the participant/sponsoring organisation (the Participant) upon registration for the Peak Positive Coaching Foundations Programme. The programme is aligned with the EMCC Global Foundation-level standards (EQA-approved outline).

1. Programme Commitment, Fees, and Payment

1.1. Programme Investment: The full tuition for the Founding Cohort is £1,495 per participant (no VAT is applicable for Guernsey-based clients).  

1.2. Non-Refundable Deposit (MANDATORY): A place is only confirmed upon receipt of a non-refundable deposit of £500. This secures the exclusive place in the limited 10-person cohort.  

1.3. Balance Due Date: The remaining balance of £995 is due in full no later than 4 weeks prior to the programme start date.

1.4. Late Payment: Failure to pay the balance by the due date risks forfeiture of your place. Late payments will incur an administrative surcharge of £100. Participants may not attend a module without full payment.

1.5. Installment Payment Plan: If agreed upon, each session must be fully paid in advance before attendance. If any payment is missed, participation will be suspended until payment is received.

1.6. Additional Fees: The cost of one portfolio referral is included. Should a portfolio be referred more than once, there will be an additional re-marking fee of £350.  

2. Programme Cancellation, Refunds, and Non-Attendance

2.1. Cancellation by Peak Positive: If Peak Positive must cancel (e.g., minimum 10-person requirement not met), a full refund of all fees paid (including the deposit) will be given, or an alternative date offered.

2.2. Cancellation by Participant:
14-Day Cooling-Off Period: Full refund (including deposit) within 14 days of making the initial payment.
Cancellation 43+ Days Before Start: Refund of all fees paid, less the £500 non-refundable deposit.
Cancellation 0-42 Days Before Start: No refunds are applicable You will be charged 100% of the total programme fee.
Withdrawal After Programme Start: No refund is applicable.

 2.3. Deferral Policy (Protecting the Cohort): All deferrals are subject to the sole discretion of Peak Positive and must be for exceptional circumstances.
Deferral Before Completion of Module 3: Required to restart from Module 1.
The deferral fee is an additional cost equivalent to 50% of the full program investment (£747.50) to secure a place in the new cohort.
This fee must be paid in full before the start date of the new programme.
Deferral after Module 3: Typically not permitted; additional fees will apply if agreed.

2.4. Non-Attendance of Supervision: Failure to attend any mandatory group supervision sessions (4) will incur a fee of £175 for alternative catch-up arrangements.

3. Accreditation and Portfolio Submission

3.1. EMCC Compliance: The learning portfolio must be submitted within a maximum of 12 months of the final workshop date. This is a non-negotiable timeframe for the validity of your individual accreditation (EIA).

3.2. Portfolio Submission Deadline: The suggested deadline for submission is 6 months after the final workshop.  

3.3. Extensions: After the 12-month EMCC deadline, extensions are rare and may incur additional fees. After 18 months, resubmission requires attendance of a new, full programme.  

3.4. Termination for Non-Completion: We reserve the right to terminate the contract if you fail to complete the programme within 12 months (or 24 months with written consent).

4. Intellectual Property, Confidentiality, and Media

4.1. Intellectual Property (IP): All materials are the sole IP of Peak Positive. We licence rights for you to attend and complete the programme only.  

4.2. Permitted Use: You may use small extracts of the content for your personal use as a coach only. Reproduction, distribution, or sale of any content is strictly prohibited.  

4.4. Audio and Visual Recording: Recording of our programmes by the participant is strictly prohibited without prior written consent.  

4.5. Media Consent: You authorise us to use your image and voice in any recordings made by Peak Positive during your attendance, without payment.

5. Governing Law, Liability, and General Terms

5.1. Governing Law and Jurisdiction: Contracts will be governed by Guernsey Law and shall be subject to the exclusive jurisdiction of the Guernsey courts.  

5.2. Liability: Our liability for losses you suffer as a result of us breaching the Contract is strictly limited to the purchase price of the programme.  

5.3. Entire Agreement: These T&Cs represent the entire agreement between us.
